Donald Trump’s Civil Fraud Case

A New York court decisively rejected defense petitions alleging prosecutorial misconduct on Monday. New York judge, Juan M. Merchan, had ruled that former President Donald Trump will begin trial for his four separate criminal cases on April 15. Also, Judge Merchan refused the defense’s request to further delay the trial.

Moreover, the judge stated the former president’s legal team made baseless claims about the validity of the charges of hush money being brought against him. Some of the allegations brought against him are charges of hush money payments used to conceal allegations of marital infidelity from the 2016 presidential elections. Nonetheless, Trump is set for trial roughly three weeks from now.

Dates Changed

Donald Trump and his co-defendants in the New York civil fraud case now have 10 days to deliver $175 million. Unlike the original $464 million civil fraud judgment that was first due on Monday, according to a state appeals court ruling.

Former President Trump felt significant relief and triumph. After an 11th-hour verdict by a panel of state Appellate Division judges all of whom were chosen by Democratic governors. Their counsel had said that coming up with the greater bail was a “practical impossibility.” Also, the decision means that the office of state Attorney General Letitia James cannot yet start collecting on the judgment.

Assuming the date remains unaltered, Judge Juan M. Merchan’s decision ensures that the prosecution will be the first of four criminal proceedings against Trump to go to trial. A jury will hear the Republican nominee’s case in the city of New York. There, decades ago, he became famous and built himself an empire in commerce.

Postponed

Donald Trump’s lawyers argued that the thousands of pages are potentially significant and need a thorough examination. Further stating they believed the prosecutors had purposely omitted the documents to gain an advantage.

Meanwhile, Assistant District Attorney Matthew Colangelo, said that just a small number of those documents were pertinent to the case. Colangelo was also cited stating only around 300 of the documents were relevant. Conversely, Trump’s lawyers claim the number to be more around thousands.

Merchan had earlier this month postponed the trial to at least mid-April. Moreover, the DA office told the former president’s lawyers they ought to have taken action far sooner and they are at fault for waiting till January to subpoena the documents.

These records refer to the information from the 2018 federal investigation. In addition, this 2018 investigation ended with Donald Trump’s former lawyer, Michael Cohen being sent to prison. Furthermore, Michael Cohen is incidentally set to testify against Trump at the upcoming trials.

After leaving a New York courtroom for a hearing in the hush money case Trump spoke in front of cameras. He stated, “I greatly respect the appellate division’s decision and I’ll post the $175 million in cash or bonds or security or whatever is necessary very quickly within the 10 days, and I thank the appellate division for acting quickly.”

Donald Trump was responsible for $454 million, or the majority of the fraud judgment, prior to Monday’s decision. Nevertheless, additional interest has been driving up his debt by more than $111,000 every day.

Trump announced on social media on Friday that he intends to use his almost $500 million cash reserve for his 2024 presidential campaign. However, since 2016, the former president hasn’t funded his presidential ambitions with his own funds.

Apart from this, Donald Trump is also being tried for conspiring to overturn 2020 election votes, as well as illegally retaining classified documents. These cases are predicted to be the main ones ongoing within the next few months.

Attorney General Letitia James of New York said ABC News that if former President Donald Trump cannot find the money to pay. With the $354 million fine in his civil fraud case, she is ready to confiscate his assets. The judge made the order for him to pay the money four days ago.

In an interview with Aaron Katersky of ABC News, James said, “If he does not have funds to pay off the judgment, then we will seek judgment enforcement mechanisms in court and we will ask the judge to seize his assets.”

The former president stated that he would file an appeal and denied any misconduct. Letitia James reiterated that her office would not hesitate to seize Donald Trump’s assets.

Moreover, she mentioned specifically his 40 Wall Street skyscraper if the former president is unable to find the money to cover the court-ordered disgorgement. James said she was very confident in the strength of her case on appeal.

Making It Right

Regarding the typical court procedure for collecting judgments in civil cases, Attorney General Letitia James said, “We are prepared to make sure that the judgment is paid to New Yorkers, and yes, I look at 40 Wall Street each and every day.” James strongly disputes Donald Trump’s claim that there were no victims in the case, stressing the importance of her case in guaranteeing that New Yorkers receive treatment properly by the financial markets.
